On August 9th 2014, when the officer approached Mr Brown and his friend Dorian Johnson as they walk down the middle of the street. After Officer Wilson suggested Mr Brown & his friend to move to the pavement, words were exchanged. The pair carried on walking down the middle of the street, as the 2 passed, Officer Wilson noticed Mr Brown had cigarillos in his hand. Cigarillos had been stolen from a local convenience store. Wilson then called for backup & drove his vehicle in an angle to block the man pass and block the flow of traffic in both directions. There was then an altercation between officer Wilson sitting in his patrol car and Mr Brown standing at the window.
Some witnesses describe Mr Brown's hands in being raised in surrender, others said they were down or out to the side.
There were accounts from 60 witnesses who contradicted officer Darren Wilson, who gave evidence over 25 days. The contridictions seem less reliable, as they changed over time or didn't tally with physical evidence from the scene & autopsy.
